Extract of Order No. 101 dtd.02.01.23     

                            This E.A. Case No. 3/2014 (Arising out of C.C.Case No. 57/2001) put up before us today. The E.A. Case has been posted for 100 times. The Jdr not carried out the order passed on dt. 15.05.2004. Being aggrieved the Op No.1 filed appeal No. 471/2006 SCDRC and the said appeal was dismissed by the Honbl’e SCDRC on dt. 11.06.2013. Then the Dhr filed E.A. Case No. 3/2014 (Arising out of C.C.Case No. 57/2001) wherein this DCDRC office issued notice to the Jdr No.1 on dt. 05.02.2014. At present the same is pending till today. The Complainant had not never taken any step to issue warrant for implementation of order dt. 15.05.2004. Further  it is a great concern to this Commission that the Dhr did not appear & not taken any step from dt. 30.10.2019 as it is shown from the order sheet, the Complainant/Dhr remained regularly absent and not taking any step. Therefore it is desirable to drop the present E.A. Case No. 3/2014 due to non-prosecution.

                   From the above observations and findings from the materials available on record the present E.A. Case No. 3/2014 is hereby dropped & accordingly disposed off.
