MR. BIBEKANANDA DAS, MEMBER :-

                 The Complainant has filed the C.C.Case No. 204/2023 U/s-35 of C.P.Act, 2019 seeking the following relief:

           “ After hearing the both parties the Hon’ble Commission directed to the Op  to return of the vehicle/machine i.e Hydraulic Excavator- SY 215 C MC SL No. 22SY215C000456 to the complainant and passed an appropriated order. Further directed to the Op to pay Rs. 3,20,000/- towards compensation of loss of business, mental agony & litigation cost”.

                Final award under Arbitration and Conciliation Act-1996 has been passed on 25.10.2023 i.e, much prior to filing of this case before this Commission on dt. 17.12.2023. As such the consumer complainant is not maintainable and accordingly the C.C.Case No. 204/2023 along with I.A Case No. 135/2023 are hereby dismissed. No order as to cost.

                         Issue extract of the order to the parties concerned.
