This C.C.Case No. 60/2023 has been filed U/s-35 of C.P.Act, 2019 seeking following relief:-
Honbl’e Commission may direct the Ops to exempt the loan of Complainant from payment, If there is Guideline of Govt. is available, otherwise taking consideration of aforesaid fact the appropriate order be passed for payment of loan without interest with installment.
Brief fact of this case is that Complainant has taken loan of Rs. 42,000/- in the year 2015.But due to natural calamity it was told by the Manager, that Govt. has exempted the loan. The Op objected the C.C.Case for maintainability and denied regarding any existence of any scheme so also assurance and denied the existence of any Govt. guidelines.
We find no deficiency as the relation between the Complainant & Op is that of debtor and creditor and there is no element of deficiency in service.
However, taking a lenient view we dispose off the C.C. with an observation that if the Complainant makes an application for OTS, the same may be considered sympathetically keeping in view the age of the Complainant and long standing pending dues and try to give maximum relaxation as due and admissible as per the guidelines/norms/scheme etc.
With the aforesaid observation and direction the C.C.Case No. 60/2023 is accordingly disposed off.
Issue extract of the order to the parties for compliance.
