Complainant has filed the C.C.Case No. 54/2023 U/s-35 of C.P.Act, 2019 seeking following relief:-
Hon’ble Commission may direct the Op to be free from freezing and allowed to withdraw his saving money from his S/B Account No. 55610110009315 and Rs. 1,20,000/- towards the compensation to the Petitioner for financial loss, mental agony”.
Keeping in view the aforesaid fact and circumstances of the case, we direct the Ops to retain the amount transferred to the account of Complainant and block the said amount or keep the amount in a separate account and on confirmation of all parties the same shall be released in favour of the person/authority who will satisfy the Op. The Op shall take 15 days time to find out the disputed amount if any.
The Op shall allow the applicant to operate his account after 15 days of receipt of the order and we impose no cost as Op-Bank has held up the Account due to the order of state authority and treat the deficiency as unintentional.
With the aforesaid observation and direction the C.C.Case No. 54/23 is allowed and accordingly disposed off. No order as to cost.
Issue extract of the order to the parties concerned.
