MR.PRAVAT  KUMAR PADHI,  PRESIDENT.:-     

            Heard counsel for Complainant, O.P.No.-1 & O.P.No-. 3. It is submitted by the counsels that the matter in respect of vehicle no.OD02CL 5593(Yamaha)   is under investigation by Police and after receipt of Police report the insurance claim shall be settled.

             We therefore held that the C.C. is premature and there is no deficiency in service on the part of O.P.No.-1.

             We  therefore  dispose   of the   C.C. with  a direction  that the O.P.No-1   shall  settle  the  Insurance    claim  in respect of Policy   No.YHMB/BAG23099263   within  60 days after  submission  Policy report  by the complainant. The O.P.No.3  shall receive the  amount  and if there is  surplus amount then surplus amount shall be released  in favour of Complainant within 7 days and if  there is shortfall then complainant  shall pay the shortfall amount  within  60 days  and  thereafter   the O.P.No.3  shall  issue NOC  in respect of the vehicle  .

           With the aforesaid observation and direction the C.C.Case No. 20/2024 is accordingly disposed off.   No cost.

                         Issue extract of the order to the parties for compliance.
