MR. BIBEKANANDA DAS, MEMBER :-

      The Complainant has filed the C.C.Case No. 85/2023 U/s-35 of C.P.Act, 2019 seeking the following relief:

  “ After hearing the both parties the Hon’ble Commission directed to ply the JCB Machine Excavator Loader vide Chasis No. 1873369 and not to stop the vehicle.

      Heard the Ld. Counsel from both the parties in length. Perused the documents available on record and also gone through the complaint petition & so also the written version filed by the Ops.Agreement period is over since 2018. Admittedly complainant is a defaulter. Relationship between Complainant & Ops is that of Debtor & creditor.

       Counsel for Complainant submitted that he wants to settle the loan in OTS. Taking a lenient view we direct the Ops to consider the OTS application sympathetically in accordance with Rules and dispute of the same within 30 days.

     Hence, we find no merit in the C.C. and accordingly the C.C.Case No. 85/2023 is hereby dismissed. No order as to cost.

                         Issue extract of the order to the parties concerned.
