MRS. SUSMITA MISHRA, PRESIDENT:-

          Complainant has filed the C.C.Case No. 57/2023 U/s-35 of C.P.Act, 2019 seeking following relief:-

            “Hon’ble Commission may direct the Ops not to handover the vehicle to any purchaser and to award the compensation to the Petitioner for financial loss, mental agony”.

            The Vehicle in question bearing Regd. No.OD-29J-7791 has already been auctioned on dt. 27.03.2023, that is prior to filing of consumer complainant on dt. 11.04.2023. The Complainant was defaulter of 4 nos. of EMIs. The relation between Complainant & Op is that of Debtor & Creditor and we find no deficiency in service on the part of Ops.

Hence the consumer complaint is devoid of merit & accordingly the C.C.Case No. 57/2023 is herby dismissed. No order as to cost.

                              Issue extract of the order to the parties concerned.
