Final Order / Judgement

           The instant petition (Ptn. No. 143) is filed by complainant praying for compensation for the loss sustained, to the tune of Rs. 11,33,207.80/-, as a result of fire incident that occurred on 10.10.2018 at around 12:20 AM at the business establishment of complainant under the name style of “G. K. AUTO SPARE PARTS” at Barama Pub Chowk , Barama, Dist.- Nalbari, Assam.

 

             The case of the complainant, in brief, is that on 10.10.2018 at night at around 12:20AM his shop establishment caught fire. His shop was covered against fire and allied perils under Insurance Policy of United India Insurance Company Limited, bearing policy No. 1310032617P112820348 valid from 08.12.2017 to midnight of 07.12.2018, for sum assured of Rs. 11,00,000/- (Rupees eleven lac)only. Complainant claims that the Surveyor and loss Assessor of the company assessed the loss caused to insured shop at Rs. 14,22,015/- But the Insurance Company credited an amount of Rs. 3,46,000/- to the Bank account of complainant being compensation for the loss sustained in the fire accident. It is claimed that the complainant sustained total loss of Rs. 11,33,207.83/- whreas the Insurance company paid Rs. 3,46,000/- only which is not at all justified. Complainant states that he filed petition before the Insurance Company (OP), Nalbari branch for reassessment but to no avail.

 

          We have carefully gone through the petition and the documents submitted therewith and heard the learned counsel for the complainant.

 

          From the petition itself it reveals that the OP insurance company, Nalbari Branch, assessed loss by fire to the tune of Rs. 3,46,000/- and accordingly the amount was credited to the Bank Account of complainant. It appears that the complainant filed the instant petition for enhancement of compensation by way of reassessing the damage caused by fire. There is nothing to indicate that the complainant approached any higher authority against the assessment so made by the United India Insurance Company Limited, Nalbari Branch.

 

           Considering the facts and circumstances of the case we are of the considered opinion that this is not a fit case to admit by this Forum. Complainant may approach the appropriate Forum for redressal. Return the petition along with the documents submitted enabling the complainant to approach the competent authority having jurisdiction, for redressal.

 

            In view of the above , this petition is not admitted for hearing. The petition is disposed off accordingly.
