Member : Shri P.K. Chatterjee. Member : Smt. Jhumki Saha. F I N A L O R D E R 1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the o.p. bank to refund the sum of Rs. 37,506/- and a compensation of Rs. 70,000/- and litigation costs of Rs. 10,000/- as the o.p. bank though disbursed Rs. 7 lakhs as house building loan against sufficient security and mortgage provided by the complainant, has deducted Rs. 37,506/- on the plea of Bajaj Allianz Insurance Policy without the consent of the complainant. 2. The o.p. bank in the written version contended interalia that the borrower must be an insurance holder as nominated by the bank itself and it is mandatory 3. Upon pleadings of both parties two points arose for determination : i) Is there any deficiency in service on the part of the O.P. ? ii) Whether the complainant is entitled to get any relief as prayed for ? DECISION WITH REASONS : 4. Both the points are taken up together for consideration. Admittedly a house building loan of Rs. 7 lakh was sanctioned and disbursed by the o.p. bank with EMI of Rs. 11,086/- for 84 months. In spite of keeping security of LIC Bond of Rs. 1,87,300/- plus Rs. 1 lakh, plus Rs. 1,25,000/- plus Rs. 1 lakh together with the property in mortgage, the o.p. bank arbitrarily deducted Rs. 37,506/- from the loan account as Bajaj Allianz Credit Life Insurance with whom the Bank has tie-up. This is altogether surprising. How, in spite of sufficient security obtained from the complainant, the o.p. Bank can pressurize him for the credit life insurance and deduct Rs. 37,506/- in a capricious manner ? This is just an instance of unfair trade practice and cannot be supported in the eye of law especially when the complainant has been paying the EMI regularly. 5. We are, therefore, of the view that the prayer of the complainant shall be allowed. Both the points are accordingly disposed of. Hence, O R D E R E D That the C. C. Case No. 307 of 2013 ( HDF 307 of 2013 ) be and the same is allowed on contest with costs against the O.P. The O.P. Bank be directed to refund the sum of Rs. 37,506/- together with interest @ Rs. 9% p.a. since 21-06-2013 till full satisfaction, within 30 days from the date of this order. The o.p. do further o pay a sum of Rs. 5,000/- to the complainant as litigation costs. No order as to compensation.
