Shri Sundar Lal Behera, President :- The Consumer Complaint in brief is that, the father of complainant was a consumer of O.P having account No. SB-354002010010418 in which the complainant is the nominee. The said father of complainant unfortunately died on dtd. 15.04.2016. The complainant approach the O.P to give the amount laid in the account of his father by furnishing death certificate but the O.P refused to give the said amount, hence this case.
The O.P after being noticed failed to appear and stand ex-parte.
Heard from the complainant and gone the documents. The complainant filed copy of Bank Pass Book, Death Certificate of his father, and certificate of disability and medical checkup prescription of his mother with an affidavit that he the nominee in the said bank account of his father vide Bank Account No. SB-354002010010418. The O.P kept silent in this case which means he has nothing to say.
Hence we are in considered opinion to allow the complaint case and direct the O.P to pay the amount lying in the bank account of complainant’s father to the complainant and pay a sum of Rs. 3,000/- (Rupees three thousand) only to the complainant towards harassment, metal agony including cost of the case within 30(thirty) days from the date of receipt of this order failing which interest @10% will be charged on the awarded amount till realization.
Accordingly the case is disposed of.
Order pronounced in the open court today the 22nd day of December’ 2017 and copy of this order shall be supplied to the parties as per rule.
