1. These revision petitions have been filed under Section 21 (b) of the Act 1986 in challenge to the Order dated 11.07.2014 in Appeals No. 38 & 42 of 2010 the State Commission Bihar arising out of Order dated 10.12.2009 of the District Commission in Complaint no. 103 of 2006. 2. Heard the learned counsel appearing for the parties and have perused the record including inter alia the Order dated 10.12.2009 of the District Commission, the Order dated 11.07.2014 of the State Commission and the petitions. 3. This Commission’s Order sheet dated 04.07.2023 reads as follows: Nobody appears for the Petitioner. The Petitioner has not filed the application for bringing the LRs on record as the Petitioner has expired as per the Order dated 02.11.2022. As a last opportunity, one month time is granted to the Petitioner to bring the LRs on record and file the amended memo of parties. In the meantime, the written synopsis shall be filed by both the parties. List in the category of ‘directions’ on 16.08.2023. 4. Learned counsel appearing for the petitioner submits that the legal heirs have not been substituted so far nor any application in that regard has been moved. Learned counsel for the petitioner further submits that he has not received any instructions for the purpose of substitution so far. 5. In the afore-said circumstances, the petitions stand dismissed for non-prosecution. However, in the interest of justice it is being observed that in case the legal heirs of petitioner are interested to pursue the matter in right earnest, an appropriate application to seek recall of the Order may be moved within three months from today. 6. The Registry is requested to send a copy each of this Order to all parties in the petitions and to the learned counsel for the parties. The stenographer is requested to upload this Order on the website of this Commission immediately. |
