Instant complaint has been filed by the complaints u/ 12 of C.P. Act, 1986 for an order to the OP to deposit the amount of Rs.66, 250/- with interest in favour of the complainants in aforesaid Bank Account along with a sum of Rs.15, 000/- as compensation for harassment and mental agony.
The fact of those complainants’ case, in brief, is that the complainants are the partners of a Regd. Partnership Firm named “Purna Chandra Filling Station” which is a business of petrol and lubricating oil for their livelihood. Those complainants are the customers of the OP Bank/Branch Manager, UCO Bank, Berhampore Branch with a Bank Account bearing No. 08170200000154 for their Firm. Partners/complainants deposited eight cheques in the s aid account in respective forms.

Afterwards, complainant find out in the account of statement that those cheques have not been credited in their s aid account. Then and there, the complainants informed the OP both verbally and in writing but the OP was silent on the said matter for long period which is a clear example of unfair trade practice by the OP. The complainants did not find out the reasons behind non-credit of those eight cheques by the OP as well as non-response from the said OP, which is clearly a major deficiency in service by the OP. So, the complainant came to this Forum for proper redress.
On the other hand, the OP appeared in this case by filing V-nama , but getting sufficient opportunity did not submit any written version, so the proceeding runs ex parte against the OP Bank.
Decision with reasons.
It appears from the record that the OP did not file any written version till date as well as the complainant is absent without steps on six consecutive dates.
In this circumstances , we are of the view that the complainant is not interested to proceed with the case as his cheques have already been credited in his A/C by the OP and the complainant , being satisfied did not turn up further before this forum for getting his final award. At the time of hearing argument, Ld. Advocate on behalf of the OP claimed that the money was already paid to the complainant and the Ld. Advocate on behalf of the complainant submitted that the complainant informed him over phone that he got the said amount. Accordingly the case is disposed of finally.
Hence,
Ordered
that the Consumer Complaint No. 145/2015 be and the same is hereby disposed of as the grievance of the complainant stands redressed.
There will be no order as to cost.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
