Final Order / Judgement | The case record is posted today for hearing of the petition dtd.19.07.22 filed by O.P No.6. Neither the complainant nor his Advocate is present nor taken any step. Advocate for O.Ps No.1 to 3 & 5 is present and files hazira. O.Ps No.4, 6 & 7 are absent, no steps filed. On repeated calls, none respond on behalf of the complainant. Hence, hearing of the case could not be taken up. In the present case, though O.Ps No.1 to 6 were appeared, only O.Ps No.4 & 6 filed their written versions in time and O.Ps No.1, 2, 3, 5 & 7 were set ex-parte. Heard & the petition dtd.19.07.22 filed by O.P No.6 is rejected as none moves the petition. As it appears from the case record, the complainant did not turn up and slept over the matter since 18.03.2020 till today except 15.03.2022 and no step is taken nor did his advocate used to take any step on his behalf, for which hearing of the case impaired and the valuable time of this Commission is being wasted. Considering the above facts and circumstances of the case and the nature and conduct of the complainant, this Commission is of the view that the complaint of the complainant should be dismissed. Accordingly, the complaint of the complainant is dismissed for non-prosecution of the case. The interim order, if any, passed against the Ops is treated to be infructuous. | |
