Both parties file hazira. Today is fixed for hearing on the petition dated 31.10.2017 filed by the O.P. This petition is treated as M.A No. 40/2017.

The prayer of the O.P in his petition was that the OPW filed evidence in chief. The cross examination was not completed. In such situation the OPW has been transferred from Rampurhat. So, he is unavailable to cross examine. The O.P now wants to change OPW.

Heard Ld. Lawyers of both sides. Ld. Lawyer for the complainant has no objection.

                                     Prayer of the O.P is allowed.

            Thus the M.A 40/2017 be and the same is disposed of.
