This case has been filed U/s.25 and 27 of the Consumer Protection Act, 1986 filed by the Decree Holder Ranalal Biswas.

The record is taken up for passing order in respect of statement filed by the judgment debtor on 28.11.2018 and hearing the advocates of both sides on 28.8.2018 & 28.11.2018.  After perusing the documents and the case record it appears that the judgment debtor complied the order of this Forum dated 24.10.2017 and filed the bank statement in that respect. Although the Ld. Advocate of the decree holder assailed that the JDR could not satisfy the decree holder in respect of statement of accounts as it is not complete at all. The advocate on behalf of the judgment debtor submitted that they have complied the order of this Forum dated 24.10.2017 so the execution case is liable to be rejected.

After perusing the case record and statement of accounts it appears that the judgment debtor complied the order of this Forum dated 24.10.2017 in C.C. case No.07 of 2016 and the decree holder accepted the same so there is no impediment to drop the execution case being No.56 of 2017.

ORDER

Hence it is ordered that the Execution Appeal being No.56 of 2017 be and the same is dropped as the judgement debtor complied the order of this Forum.  

      Let a plain copy of this Order be supplied free of cost to the parties/their Ld. Advocates/Agents on record by hand under proper acknowledgement/ sent by ordinary Post for information & necessary action.
