                   The instant complaint u/S 25 & 27 of C.P.Act, 1986 has been filed by one Krishna Kanta Dey, Decree Holder on 16.08.2013 herein against the Judgments Debtor for execution of final order dated 07.06.2013 passed by this Forum. It was ordered that the complaint was allowed in part on cost without any order as to cost. The OP/Oriental Insurance Company Ltd. Berhampore Branch was hereby directed to pay a sum of Rs.4,21,361/- to the complainant within two months from the date of this order, failing which an interest @ 9% p.a. will carry on the aforesaid awarded amount from the date of filing of the case i.e. 10.02.2011 till final payment.

          It appears from the case record that on 05.04.17, the Jdr has filed one cheque bearing No. 015152 dated 04.04.17 for Rs. 413703/- and another cheque for Rs. 205650/- bearing No. 015153 dated 04.04.17 deposited by the Jdr on 05.04.17. Both the cheques were drawn on Bank of India, Berhampore Branch.  

The D.hr has received the aforesaid two cheques today with full satisfaction.  

We find that the D.hr has received his awarded amount in full and the Jdr has made payment of the awarded amount in full with the order of this Forum. So, we have no other alternative but to dispose of this Execution Application with full satisfaction.

Ordered

that the Execution Application No. EA/20/2013 be and the same is disposed of with full satisfaction.

 Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
