ORDER

Both parties file hazira. The petition dated 19.01.2018 filed by the O.P for issuance of summons upon the local RTO and Surveyor is taken up for passing order treating the same as M.A 22/2018.

            We find the complainant have contested the petition without filing any formal objection.

            We find from the documents submitted by the parties that some anomaly is there. So, RTO is required to be examined.

            Regarding Surveyor we find that report of Surveyor is very important document of the case. So, he is also required to be examined through the O.P has filed such application at very late stage.

However, we think prayer is liable to be allowed.

Hence,

Ordered

that the petition dated 19.01.2018 filed by the O.P for issuance of summons to the RTO and Surveyor i.e. M.A No. 22/2018 is allowed on contest. No cost.

Thus M.A is disposed of.
