Today the case was fixed for consideration. Heard. The complainant has mentioned in para No.6 of this complaint that it appears that respondents have intentionally and deliberately cheated and defrauded the complainant by levying high rate of interest, as such, there is unfair trade practice on the part of respondents and he is entitled to get the compensation whereas from the contents of entire complaint complainant has failed to disclose that what rate of interest has been charged by the OPs and what was the agreed rate of interest between the parties. From the perusal of entire complaint, it is clear that matter involved in the complaint is relating to only rate of interest and complainant has specifically mentioned that the respondents have cheated and defrauded the complainant by levying high rate of interest. Hence, we are of the considered view that this Forum have no jurisdiction to entertain and try the present complaint and the same is hereby dismissed with liberty to approach the appropriate court, if so advised. The Assistant is directed to return the original documents, if any, to the complainant after retaining the photo copies of the same on the file. Copy of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
