Today is fixed for taking steps by the legal heirs if they so desire, i.d. necessary order will be passed.

The OP Bank files hazira through Ld. Advocate. No step is taken by the legal heirs of the complainant.

Perused the case.

It appears that the complainant did not file any reply to the questionnaire filed by the OP since 24.01.2020, i.e. by so many dates and on 27.12.2021, the complainant was directed to take positive step for compliance with the said order for filing reply. On 21.02.2022 the Ld. Advocate for the complainant has informed by filing a petition that the complainant has already expired during the period of Covid 19 and his legal heirs wanted to be substituted. Since 21.02.2022 no step has been taken by the legal heirs of the sole complainant, according to Order 22 of the Civil Procedure Code, the limitation for substitution has already been over and the case has been abated.

Hence, it is

                           Ordered

that this case be and the same is abated and disposed off.
