Mr. Soumy Dutta, proxy counsel seeks adjournment on the ground that the counsel for the petitioner are not available. From the vakalatnama filed on record, we note that it has been signed by as many as three Advocates, i.e., 1. Mr. Joydeep Mazumdar, 2. Mr. Vinod Kumar, Advocate & 3. Mr. Rohit Dutta, Advocate. The proxy counsel states that Mr. Mazumdar, Advocate is appearing in the Supreme Court, Mr. Vinod Kumar, Advocate has gone to his home town and Mr. Rohit Dutta, Advocate is busy in Tis Hazari Courts. We expected that at least one of those three Advocates would certainly appear and make his submissions at the stage of admission hearing of the petition. We are not prepared to accede to the request of adjournment. In the circumstances, we are of the view that there is deliberate attempt on the part of the Advocates not to conduct the case and, therefore, dismiss the revision petition for want of prosecution. It would be open for the petitioner to take such action as he may deem fit, in accordance with law against the Advocates who were engaged by him in this case.
