Order No.18, Dated: 11.01.2017

            Today is fixed for passing appropriate order.  All the Jdrs. are present by filing haziras.  On behalf of the Dhr. a petition has been filed praying to fix a date for compliance stating that the Dhr. wants to move before the Hon’ble Apex Court against the final order passed by the Hon’ble National Commission.  On repeated calls the Dhr. himself is absent.  The petition is not verified nor it is supported by any affidavit.  On scrutiny of the record it appears that on 24.11.2016 the Dhr. by filing a petition supported by affidavit prayed to pass necessary order directing the Jdrs. to comply the order under execution stating that the Hon’ble National Commission has been pleased to dismiss the Revision Petition No.2833 of 2015 on 9.11.2016.  The order No.17 dated 15.12.2016 and the copy of the final order of R.P. No.2833/2015 dated 9.12.2016 show that the R.P. No.2833/2015 was allowed by the Hon’ble National Commission dismissing the present complaint.

            The fact as mentioned above prima-facie shows that the Dhr. intentionally suppressed the fact and made false statement before this Forum. 

            The final order passed by the Hon’ble National Commission on 9.12.2016 clearly shows that the complaint case No.170/2011 has been dismissed without any cost.  This execution case has been filed to execute the final order passed by this Forum on 17.7.2014 in D.F. Case No.170/2011.  So, at present the order dated 17.7.2014 under execution has lost its force and accordingly this execution case is not tenable.  Hence, it is

Ordered

that the execution case being No.67/2014 is rejected on contest.  

Let the copies of this order be supplied to the parties free of cost.
