ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:
JUDGMENT
Complainant has filed the consumer complaint U/s.35 of Consumer Protection Act, 2019 seeking not to repossess TATA Magic bearing Regd. No.OD-21-G-0737 and to extend loan agreement period for 2 years, reducing the EMI to Rs.5,000/- and pay compensation of Rs.1,00,000/-.
Complainant took loan of Rs.3,08,000/- on 01.01.2018 to repay in 60 monthly EMI @ Rs.9,700/- commencing from March, 2018 to February, 2023. Complainant failed to pay and violated the agreement for which on apprehension of repossession complainant has filed the consumer complaint seeking aforesaid relief. Complainant is a defaulter of loan as per agreement and there is also accounting dispute. Relationship between complainant and opposite parties is that of Debtor and Creditor.
However taking a lenient view we dispose of the consumer complaint directing the opposite parties to deduct 50% of overdue (ODI) charges provided complainant pays the entire loan within 6 months and after clearance of loan the opposite parties shall issue NDC/NOC within a month there after. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
