Final Order / Judgement

The Ld. Counsel for the complainant is present. Today is fixed for admission hearing of this complaint.

We have heard argument on the point of admissibility of the complaint and also perused the papers and documents as available in the record.

During argument it is seen by us that the instant dispute and the grievance of the complainant is still pending for decision before the Banking Ombudsman. Therefore it is crystal clear to us that the complainant has already approached before another appropriate forum for Redressal of his grievance i.e. Banking Ombudsman. It is the settled principle of law that none should be condemned twice for the same cause. As the complainant has filed this complaint the OP will have to face problem repeatedly, which will go against the Principles of Natural Justice.

Going by the foregoing discussion hence it is ordered that the Consumer Complaint being No. CC/302/2021 is hereby dismissed without being admitted. There is no order as to cost.

Let a plaint copy of this order be given to the parties free of cost as per CPR.
