This case has been filed by the complaint u/s 12 of C.P. Act, 1986 praying for refund of Rs.10, 000/- and also compensation for Rs.5,000/-.
Today is fixed for filing written version by the OPs.
By filing a petition the Ld. Advocate for the complainant states that her client is not willing to proceed with this case as an amicable settlement has been made between the complainant and the OPs. In this regard, the complainant has also filed Xerox copy of a petition which was submitted before the OP expressing his willingness to withdraw the case subject to payment of Rs.10,000/-. The OP received the application of the complainant.
In this situation, we are of the opinion that as the matter has been settled amicably between the parties, we have no other alternative but to dispose of the case as withdrawn.
Hence,
Ordered
that the Consumer Complaint No. 12/2016 be and the same is disposed of as withdrawn.
There will be no order as to cost.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
