In the result, complaint succeeds.

Hence, it is

Ordered

That the complaint be and the same is allowed on contest with cost of Rs. 10,000/- against the ops.

Ops jointly and severally are hereby directed to refund entire amount and also 12 percent p.a. interest over the said amount w.e.f. 22.05.2014 and till its full payment and it must be paid within one month from the date of this order.

For adopting such deceitful manner of business run by the ops and for causing mental pain and sufferings and loss of money and further causing of mental pain and sufferings in his professional life and further for negligent and deficient manner of service on the part of the ops, ops jointly and severally shall have to pay compensation of Rs. 20,000/- to the complainant which shall also be paid to the complainant along with refund amount, interest and litigation cost within one month from the date of this order, failing which penal damages at the rate of Rs. 200/- per day shall be assessed till its full satisfaction of the decree and if it is collected, it shall be deposited to this Forum.

Even if ops fail to comply the Forum-s order, in that case ops shall be prosecuted u/s 25/27 of C.P. Act 1986 for which further penalty and fine shall be imposed as per law against the ops.
