Smt.Anamika Nanda, Member(W): - The brief facts of the complainant’s case is that, the complainant availed loan  of Rs.5,50,000/- only from the O.Ps. and purchased one ten wheeler truck bearing Regn. No.OR-19E-7378 which the complainant was liable to pay the loan amount with interest in 35 numbers of monthly installments started from dtd. 20.05.2014 to 20.03.2017. The complainant was paying the monthly installments regularly and has paid Rs.7,82,660/- only upto dt.27.04.2017. there is four numbers of installments pending to pay by the complainant amounting Rs.87,748/- only but the O.ps. are demanding Rs.3,17,928/- only , hence this case.

The O.Ps. appeared through their counsel after being noticed and submitted that the complainant is a defaulter in making payments of installments. The O.Ps. submitted that the complainant has availed loan of Rs.54,50,000/- only and with interest the complainant was to pay Rs.7,75,952/- only vide Agreement No. JHARSU0404110001 dtd. 11.04.2014. The complainant has paid Rs.7,82,660/- only till 27.04.2014 and he has to pay Rs.2,78,280/- only as on 19.06.2017. The O.Ps denied all the allegations imposed by the complainant and prayed for dismissal of the case.

Heard and perused the case record along with materials available. The complainant was financed a vehicle bearing Regn. No. No. OR-19E-7378 by the O.Ps. for an amount of Rs. 5,50,000/- only which was to be refunded with interest in 35 numbers of monthly installments started from dtd. 20.05.2014 to 20.03.2017. The complainant has paid Rs.7,82,660/- only as on dtd.06.05.2017 and upto dated 19.06.2017 the complainant was to pay Rs.2,78,280/- only. The period of loan agreement has been expired on 20.03.2017.   

In the above observation we are in considered opinion to allow partly the complaint case with direction to the O.Ps to issue afresh statement of accounts in favour of the complainant and receive the outstanding dues amount from the complainant.

            Accordingly the present complaint case is disposed of.

Order pronounced in the open court today the 20th day of December’ 2017 and copy of this order shall be supplied to the parties as per rule.
