ORDER

Shri Sudip Majumder- President-in-Charge.

Today is fixed for passing order in respect of the Review Application filed by the OP No. 2 dated 24/01/2024. Both parties file hazira through their respective Ld. Advocates. Already heard Ld. Advocates for the both parties. Objection raised by the Ld. Advocate for the complainant.

One Review Application has been filed by the OP No. 2. The same has been registered as M.A. Case being No. 27/2024. Record is now taken up for passing order.

Perused the petition. Considered. From the content of the petition it appears that the OP No. 2 intends to review the previous order of this Commission vide No. 04 dated 04/12/2023.

It appears from the case record that the case has already been run exparte against OP Nos. 1 and 2 vide order No. 04 dated 04/12/2023.

Sec. 68 of the C.P. Act, 2019 shows that “Every order of a District Commission or the State Commission or the National Commission, as the case may be, shall, if no appeal has been preferred against such order under the provisions of this Act, be final”.       

In view of Sec. 68 of the C.P. Act, 2019 we are not empowered to vacate our own order.

Hence, the amendment petition being M.A. Case No. 27/2024 is considered and rejected on contest without any cost.

Fix. 02/04/2024 for exparte argument and filing W/N/A 2 days ahead.

Copy of this order be supplied to the parties each at free of cost.
