ORDER

The record is taken up at the instance of the Complainant.

            The interim petition filed by the complainant is to be disposed of.

            Considering urgency the record is taken up for hearing.       

Perused the complainant and document.

            Heard.

            We find prima facie case. Issue notice.

Petition dated 29/10/2018 filed by the Complainant for passing interim order upon U/S 13(3B) CP Act is taken up for hearing treating the same as MA Case No. 127/2018.

            It is the case and the complainant that he has a Bank Account in OP/SBI. But the OP/Bank illegally has not been allowing the complainant to operate said account.

            Hence this Petition for directing OP/Bank to Open/Unfreeze said Account by the Complainant.

            We find that a writ petition being No. 14339(W) of 2018 is pending before Hon’ble High Court Calcutta regarding loan of their family inmates and an injunction was passed there against their family inmates.

             We think before passing interim order OP/Bank is to be given opportunity to place their case.

            Accordingly the petition U/S 13(3B) Cp Act i.e MA Case No. 127/2018 is rejected at this stage.

            However Issue notice upon OP/Bank directing them to file show cause as to why the prayer of the complainant shall not be allowed.

            Fix. 27/11/2018 for hearing interim matter and filing show cause by the OP/Bank.
