Final Order / Judgement

18 -05-2018                The appellant has deposited a fixed Deposit confirmation receipt of Rs. 2500/- only vide A/c no. 720700UP00003403 dated 05.04.2018 drawn on Punjab National Bank. Let the original FDR be kept in safe custody and the zerox copy on record.

        Respondent files written notes of argument. Heard the counsel for the appellant and respondent and perused the impugned order. From the admitted facts that loan was taken by the complainant which remain unpaid even after allowing the benefit of waiver scheme. The complainant filed the complaint with the statement that he had deposited Rs. 3,00,000/- to the representative of the bank was found to be baseless. The complaint was as such dismissed with cost Rs. 5,000/-. The appellant submits that the cost should not have been given. The bank submitted that for filing the complaint on baseless grounds was rightly dismissed with cost. Considering the submissions of the parties and in light of the complaint we do find any reason to interfere with the order under appeal. It is accordingly dismissed. The amount of Rs. 2,500/- deposited by the appellant as per the F.D.R today be same be released in favour of the respondent bank through this branch Manager. The appellant to pay the balance of amount of cost Rs. 2,500/- to the bank.
