O R D E R

The case of the Complainant in short is that he had deposited Rs. 20,000/- on 04-07-2014 in the scheme namely FI-SAHARA.A.Select Under Sahara Credit Cooperative Society Limited and obtained the receipt and certificate bearing certificate No. 504000071554 from the office of the Opposite Party. The Maturity date of the said scheme was on 04-07-2015. On the date of maturity the Complainant presented the said certificate before the Opposite Party of phulbani Branch and fulfilled the requirements to get the maturity amount. The O.P advised him to wait for about one month for confirmation of the payment by Head office situated at Lucknow. But no payment was made in his favor in spite of repeated approach. On 22-01-2016 for the last time the Complainant visited the office of the O.P to get his maturity amount but the O.P avoided to pay the maturity amount to the tune of Rs. 22,000/- . Hence, this complaint is filed by him against the O.P to get the

maturity amount of Rs. 22,000/- along with 12% annual interest from the date of maturity till the date of payment and claimed compensation of Rs.5,000/-  and also Rs. 5000/- for litigation cost .

The O.P was set exparte on 01-06-2016 as he was not appearing in the forum in spite of getting notice in this case.

We have heard the Complainant and gone through the complaint petition and the documents filed by him in support of his case. It is seen from the certificate issued by the O.P that the Complainant deposited Rs. 20,000/- in the aforesaid scheme on 04-07-2014 for the period of 12 months. The date of maturity was 04-07-2015. In the meantime one year is going to be passed from the date of maturity of the said certificate. As per said certificate the Complainant is entitled to get Rs. 22,000/- as maturity amount on 04-07-2015. Nonpayment of maturity amount within the reasonable time amounts to deficiency in service .Due to negligence of the O.P the Complainant is suffering since last one year .The O.P is not interested to context in this case. Hence, the complaint filed by the Complainant is allowed exparte against the O.P.

The Opposite Party is directed to pay Rs. 22,000/- the maturity amount to the Complainant along with 12 % annual interest from the date of maturity it is 04-07-2015 till the date of payment. The O.P is further directed to pay Rs. 5,000/- to the Complainant as compensation and litigation cost.
