The Complainant Smt. Mithu Rani Debnath, set the law in motion by presenting the petition U/S 12 of the Consumer Protection Act, 1986 complaining deficiency of service against the O.P.
The complainant case, in brief, is that the Complainant Smt. Debnath invested Rs.24,000/- in one fixed deposit certificate on 23/04/2013 with the O.P. The maturity date of that certificate was of 12/04/2019. After maturity date she approached to the O.P., Sahara India Pariwar, Agartala, Sector Office on 23/04/2019 and also verbally requested one of the staff of this Branch Office to take necessary action but she was replied that maturity value of her FD would not be paid to her before 2022 AD and she was advised to convert the above said FD to the other account again.
2.Notice was served upon the O.P., Sahara India Pariwar but the O.P. did not appear to contest the case. So the case proceeded exparte against the O.P. by an order dated 26/07/2019.
3.The Complainant filed evidence in affidavit and also five(05) documents in support of her case through a Firisti dated 21/05/2019. These documents were marked as Exhibit-I series viz 1). Copy of Fixed Sahara Certificate for Rs.24,000/-, 2). Copy of payment receipt, 3). Copy of Aadhar Card, 4). Copy of voter ID & 5). Copy of Affidavit dated 12/05/2015 declaring that Smt. Mithu Rani Debnath & Smt. Mithu Debnath are same person and identical one. All the documents were compared with the originals and thereafter marked Exhibits-I series.
The Complainant produced the Statement of Affidavit in-Chief and she repeated the complaint petition in her Affidavit and stated that after completion of maturity period of her FD Certificate had approached to O.P. to get payment of the matured amount against her FD Certificate and according to her calculation amount stood at Rs.56,400/- .
We have gone through the evidence and the documents field by the Complainant. As per terms and conditions as written in the Certificate it was found that she is entitled to get an amount of Rs.51,120/-(Rs.24,000/- x 2.13 LBP) against the value of her FD Certificate as already the date of maturity expired on 12/04/2019. Therefore in our consider opinion it was a case of deficiency of service by the O.P., Sahara India Pariwar. The Complainant is thus entitled to get compensation and also matured value of the FD Certificate.
We accordingly direct the O.P. to pay Rs.51,120/- to the Complainant being matured value of the Certificate. She is also entitled to get Rs.15,000/- for suffering harassment and mental agony/pain etc. and Rs.5,000/- for costs of litigation. In total she is entitled to get Rs.71,120/- (Rs.51,120/- + Rs.15,000/- + Rs.5,000/-) . The payment is to be made within 2 months from the date of judgment if not it will carry interest @ 9% per annum.
