Today is fixed for taking steps by the Complainant. No step is taken by the Complainant. The record shows that no step was taken by the Complainant on 01.07.20, 29.09.20, 27.11.20, 10.02.21, 23.03.21, 17.06.21, 02.12.21, 29.03.22, 27.06.22, 26.09.22, 18.01.23, 14.07.23 and today i.e. on 03.10.23. The case of the Complainant as per materials on record is that the Complainant invested Rs. 1300/- for the period of 60 months in Sahara Credit Co-Opp Society Ltd. Scheme vide Account No. 311022703401. The said account was opened on 24.01.13. The Complainant deposited the amount of Rs. 1300/- as regular basis. The said account was matured on 24.01.18 and after maturity the Complainant went to the office of the OP No.1 and claimed the deposited amount with interest. But the OP No.1 disclosed that the Complainant would get the said amount after few months later. On 04.04.18, the Complainant again went to the office of the OP No.1 and demanded the claim amount. But the OP No.1 was reluctant to pay the claim amount. Thereafter, in several times the Complainant went to the office of the OP and requested them to disburse the claim amount. But the OPs did not take any proper initiative to disburse the claim amount. The record shows that the Complainant had not been taking steps since 01.07.20. The Complainant was also directed to file fresh requisites for issuance of notice upon the OPs but the Complainant has not complied with the order of this Commission. So the OPs have no scope to defend the case of the Complainant. Such being the position the complaint is not entitled to get any order in the instant case. In view of the matters discussed above we are of the view that the instant case is liable to be dismissed on merit. In the result, the Consumer case fails. Fees paid are correct. Hence, it is Ordered that the complaint Case No. CC/189/2019 be and the same is dismissed on merit against the OPs. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
