FACTS IN BRIEF
Briefly stated that the case of complainant is that, he had invested Rs.7, 78,929/- in fixed deposit and procure 25 fixed deposit certificates from SAHARA CREDIT CO-OPERATIVE SOCIETY LIMITED BHAWANIPUR SECTOR (1583). The amount on maturity of those Certificates would be Rs.9, 12,121/- on 14.12.2021 and 17.12.2021 complainant issued two letters for demanding the Payment of said maturity from the OP. The Opposite Party acknowledged the same but did not make Payment to that effect. Thereafter complainant filed this case, with a Prayer for direction upon the OP. Opposite Party received summon, but did not appear and contest this case. So, the case was heard ex parte. Complainant filed Evidence-on-Affidavit and also filed Original Certificates. From the Certificates, we find, the said Certificates already got matured on dated 30.11.2019 and 15.12.2019. DECISION WITH REASONS We have considered the petition of complaint, Evidence-on-Affidavit and also the documents as mentioned aforesaid. We have carefully perused the record, and found that the complainant is a “Consumer” under the Consumer Protection Act, 2019 and he was deprived of service from the OP. From the documents we find that complainant invested in Fixed Deposit of Rs.7, 78,929/- by 25 Certificates and paid the total amount of the certificates. But on maturity, he did not get the amount on maturity. From the documents we find, the said certificates already got matured on dated 30.11.2019 & 15.12.20219. So, complainant is entitled to get relief (s) in this case. So, he is to get Rs.9, 12,121/- being the amount on maturity and also get compensation and cost of litigation.
Hence, it is ORDERED That the instant case be and the same is allowed ex parte against the OP. OP is directed to pay Rs.9,12,121/- (Rupees Nine Lakh Twelve Thousand One Hundred Twenty One Only) along with interest @10% per annum to the complainant from the date of maturity of the respective certificates until actual payment. OP is also to pay Rs.2, 000/- (Rupees Two Thousand Only) towards cost of litigation. OP is directed to pay the aforesaid amount to the complainant within 45 days on the date of this order, failing which the complainant shall be at liberty to proceed in accordance with law.
