ORDER

Present Complaint has been filed against the OP alleging deficiency in service through not assisting the complainant in identification of the acused committing fraud through changing the complainant’s ATM card on the plea of assisting him in Operating the ATM machine for withdrawal of desired amount by the complainant. This is a clear act case of fraud by some unknown not any of the opposite parties. Once the matter was relating to ATM, ATM Manager of the SBI was the necessary party but the above said facts and the circumstances and te OP having no role at all in the operation of the ATM machine by the complainant 9am of the firm view that the OP cannot be alleged to have committed to any kind or degree of deficiency in service to the complainant. In view of above said facts and status and the role of the parties referred above the complaint is dismissed in view or nature of allegation as well as the defect of necessary party.

Let the copy of this order be served to both the parties free of cost as per rule.
