Both Complainant and O.P. no.1 file hajira.  O.P. no.1 files a petition praying for vacating the exparte order against him.

Let the petition be registered as Misc. Case No.39 of 2018.

Heard Ld. Lawyer for the O.P. no.1.  The O.P. no.1 stated that they have filed W.V. and contested with the case as per order of the Forum but due to non-availability of necessary documents in connection of this case the O.P. no.1 did not take proper step.  The o.P. no.1 also stated the latches of the O.P. no.1 is not willful latches it was happened on the part of the insurance company.  However, the ground stated by the O.P. no.1 is not satisfactory and the Complainant must not suffer for the latches of insurance company.  Prayer of the O.P. No.1 is allowed subject to the cost of Rs.1000/-, 50% of which will be payable to the Complainant and rest 50% will be deposited in Consumer Welfare Fund.

Thus Misc. Case no.39 of 2018 be and the same is disposed of.
