Learned counsel for O.P 1 & 2 urged to dismiss the complaint as the complainant is not appearing on the date fixed for hearing. Heard .Perused the previous order and found that complainant is remaining absent consistently .No evidence is adduced by the complainant to substantiate his claim. Law is well settled that mere pleading may not be taken as evidence. Onus lies on the complainant to prove the allegation made against the O.P .but here the case complainant has failed to prove the allegation made in the complaint petition. Hence, this consumer complaint is dismissed against the O.Ps for non-prosecution.
