The case is fixed for argument.
After hearing arguments from both sides the Commission proceeds to dispose of the case as hereunder: -
The complainant’s case is that he has a Current A/c. with O.P.2 Bank No. being 201010789648 wiith ATM Debit card and on 05-08-2022 in the early morning the Complainant visited the ATM counter of O.P.1 Bank at Onda Branch, Bankura to withdraw Rs.10,000/- and swiped the ATM card for the same but at that moment the ATM machine got blocked and the complainant did not receive the amount in hand but received the transaction detail through SMS. Thereafter the complainant approached both the Bank authorities for refund of the said amount but of no avail. Though O.P.2 Bank attended the pre-mediation hearing at C.A. & F.B.P., Bankura R.O. but O.P.1 Bank never turned up there. Ultimately the complainant approached this Commission for proper relief.

In spite of service of Notice O.P.1 Bank did not come forward to contest the case but O.P.2 Bank contested the case by filing Written Version contending inter alia that they have no liability in such transaction.
-:Decision with reasons:-
Having regard to the facts of the case, materials on record and the contention and submission on both sides the Commission finds that O.P.1 Bank after receipt of the complaint sent the same by email to the concerned ATM authority on 08-11-2022 for resolution stating therein clearly that though the amount Rs.10,000/- was deducted on 05-08-2022 from Punjab National Bank ATM near Onda but the said amount has not yet been disbursed and refunded and the reply message is on record from the concerned ATM authority to the effect that no excess cash found on 05-08-2022 at the said ATM counter number being F1052520.
It is the duty of the O.P.1 Bank to disprove the Complainant’s case by producing CCTV footage and other relevant materials that the complainant received the amount of Rs.10,000/- from the ATM counter but nothing has been done by O.P.1 who preferred not to turn up and contest the case. In fact O.P.2 Bank has no liability in such transaction as they have to carry forward the ATM transaction of other bank and reflect it by debiting the withdrawal amount in the Account of the complainant and O.P. 2 Bank do not have any material regarding ATM transaction of other bank. O.P.2 bank can furnish ATM transaction details of their own bank only.
The Commission thinks that O.P.1 Bank has avoided their liability and failed to counter the claim of the complainant and for that reason they did not participate before this Commission.
In absence of any cogent proof regarding withdrawal of the amount of Rs.10,000/- by the complainant from the Punjab National Bank ATM counter at Onda branch the Commission decides the case in favour of the complainant by granting the relief as prayed for.

Hence it is ordered……..
That the case be and the same is allowed on contest against O.P. 2 but Ex-parte against O.P.1.
O.P.1 is directed to refund to the complainant Rs.10,000/- within a fortnight in default O.P.1 is to bear the compensation of Rs.5,000/- in addition to the decretal amount of Rs.10,000/- .
Both parties be supplied copy of this Order free of cost.
