Hazira is filed on behalf of the complainant through Advocate.
No step is taken by the O.P.
The record shows that the appearance of the O.P. could not be secured in spite of exhausting all efforts and formalities, still the O.P. failed to turn up to contest the case.
Without wasting further time the Commission is inclined to dispose of the case by passing an Ex-parte order.
The complainants purchased Gold Certificates No.105-0101946, 105-0101947, 105-0110404 (by Complainant No.1) /105-0101948, 105-0101949, (by Complainant No.2) / 105-0101688 (by Complainant No.3) from the O.P. on different dates with condition to get back the committed value after the Maturity period but the O.P. refused the same on production of the Gold Certificates and thereby committed unfair trade practice and deficiency in service for which the complainants have prayed for getting back the matured value of Rs.16,492/- payable to the complainant No.1, Rs.5,611/- payable to the complainant No.2 and Rs.12,187/- payable to the complainant No.3 with compensation of Rs.20,000/-

Perused the complaint and heard the Ld. Advocate for the complainant.
On perusal of the entire materials on record the Commission finds that O.P. who runs a ponzi scheme with intent to defraud the investors have violated the terms and conditions of the Gold Certificates by refusing return of the Matured value as described above.
Similar unfair practices have been committed by the O.P.s in different cases some of which are pending before this Commission and some are already disposed of.
The prima-facie case of the complainants is established and they are entitled to get the relief as prayed for.
Hence, it is ordered…..
That the case be and same is decreed against the O.P.s.
O.P.s are jointly and severely directed to pay to the complainants their respective Matured value on the Gold Certificates mentioned in the copy of judgement within three months from this date failing which decretal amount may be realized through Execution process.
Copy of this judgement be supplied to both parties free of cost.
