None has appeared on behalf of the appellant inspite of several calls. 

Learned counsel Sh. Suresh Gautam for respondent has appeared.

A perusal of the order sheet has shown that the court notice was sent to the appellant, which was delivered and as per the track report (paper No. 99) the service was deemed sufficient on the appellant.

Inspite of sufficient service of court notice, the appellant has never appeared before the Commission for placing the arguments.

In this appeal, it appears that the appellant does not contest his appeal and is not ready to come before the Commission for placing the arguments.

In such circumstances, we are of the opinion that the appeal should be dismissed on account of absence of the appellant. 

Accordingly, the appeal is hereby dismissed. No order as to costs of the appeal.

File be consigned to the record room alongwith copy of this order.

A copy of this order be sent to the concerned District Commission for perusal and necessary information.
