The case record is posted today for further order. Perused the complaint petition and documents filed by the complainant.
The complainant has filed the present case against the Branch Manager, National Insurance Company, Balasore Branch, Divisional Office in-charge of Division Office of National Insurance Company, Bhubaneswar and Branch Manager, State Bank of India, Anantapur Branch, Balasore claiming that one PMJJBY policy was opened in the name of one Shantilata Pal at SBI, Anantapur Branch, for which one SB Account was also opened in her name in the said Branch and the premium amount used to deduct from the said SB Account. The husband of Shantilata Pal was the nominee in the said policy as well as in SB Account. PMJJBY is an insurance scheme offering insurance cover for death. Said Shantilata Pal was not a defaulter in the said PMJJBY policy. However, in the meantime said Shantilata Pal got expired. But the SBI, Anantapur Branch denied to disburse the death benefit.
As it is seen from the prayer portion of the complaint petition, the complainant has prayed compensation against the OP and the OP may be directed to disburse the death benefit along with other benefits. Here, at this stage, a reasonable doubt crepts in the mind of this Commission from whom the complainant has claimed the above benefits either from OP No.1 or OP No.2 or OP No.3. It is not clear in the prayer portion. When it is admitted by the complainant that PMJJBY is an insurance scheme, under what circumstances he claims death benefit out of the said insurance policy from the State Bank of India. He has filed the complainant against three opposite parties. On whom the complainant wants to fix the liability is absent. That apart, from the documents submitted on behalf of the complainant, it is seen that he has sent legal notice only against the Branch Manager, State Bank of India, Anantapur Branch and not against the Insurance Company, who are actually liable to pay the insurance claim. Therefore, in absence of any specific prayer and inadequate documents, it cannot be said that the complainant has sufficient force to proceed with the case. Therefore, the complaint petition, being devoid of any merit, liable to be rejected.
Accordingly, the complaint petition filed by the complainant is rejected as not admitted.
