Smt.Anamika Nanda,Member (W): - Brief fact of the case is that, the complainant has availed loan  of Rs.25,60,000/- only from the O.P. on execution of loan agreement  on dtd.06.06.2016 to be repaid in 55 nos. of equal monthly installments within February,2021 against his vehicle NO. OD 15F-7342. The vehicle met with accident on dt.03.08.2017 and due to which the complainant could not paid the installments in time.  The complainant has paid an amount of Rs.6,68,465/- only against and has to pay around Rs.29,00,000/- but the  O.P is demanding entire loan amount in one time without any reason. The complainant alleges deficiency in service on the part of O.P who threatening to the seize the vehicle.

The O.P fail to appear in this case and stand ex-parte.

Heard from the complainant.  The complainant availed loan from the O.P on dt.06.06.2016 for an amount of Rs.25,60,000/- which is to be returned with interest before February,2021.  The complainant has paid Rs.6,68,465/- only till the date of filing but due to accident of vehicle the complainant not pay some of installments.

The O.P has not supplied the copy of agreement and statement of accounts so that the complainant can be able to know the actual dues.  The O.P fail to appear in this case and set ex-parte which means the O.P has nothing to say in this case.

On the above facts and circumstances, the complaint petition is hereby allowed with directions to the O.P to supply a copy of agreement with afresh statement of accounts showing proper calculation of dues to the complainant and not to mis-utilise the blank cheques of complainant if any.  

            Accordingly the case is disposed of.

Order pronounced in the open court today the 3^rd day of September’ 2018.Free copy of this order shall be supplied to the parties as per rule.
