Order No.18                                                                       Dated:-18/04/13

Both parties file hazira. Today is fixed for hearing of this case. The complainant files a petition praying for disposal of the case on the ground that he has paid the entire due amount to the Op. no.1 and taking back the vehicle in his possession from the Op. no.1. Accordingly the complainant does not want to proceed with the case further. However the complainant has prayed for a direction upon the Op. no.1 to issue no objection certificate relating to the vehicle in question and also to return back some blank cheques signed by the complainant and delivered to the Op. no.1.

Ld. Lawyer for the Ops. has fairly admitted that the dispute has been settled amicably and after making all the payments by the complainant, the vehicle in question has been delivered to him. Ld. Lawyer for the Ops. further submits that the N.O.C., blank cheque if any and other required documents will be delivered to the complainant soon.

Under the above circumstances the case is dismissed for non-prosecution. However, the Op. no.1 shall handover the no objection certificate, blank cheque if any signed and delivered by the complainant and lying in custody to the Op. no.1 and also other documents if any required to be issued on full and final payment of loan amount to the complainant within 4-weeks from this date.

Accordingly the case is disposed of.
