Perused and considered the Misc. Application dated 31/05/2023 filed by the opposite parties through their constituted Attorney on the prayer of expunging the name of opposite party no,3.
Heard the Ld. Advocates for both sides.
Ld. Advocate for the opposite parties submits that opposite party no.3 / Zonal Manager , LIC of India is not a necessary party to this Case. As such, the name of the opposite party no.3 should be expunged.
In reply, Ld. Advocate for the complainant submits that for proper adjudication and compliance of the direction of the Commission the presence of opposite party no.3 is required in the case.
On scrutiny of the record we find that written version has been filed on 31/05/2023 by opposite party no.1 to 3 through their Constituted Attorney.
Nowhere in the written version there is any whisper to expunge the name of opposite party no.3.
We are of the view that in an administrative hierarchy, officers holding the posts at different stages are bestowed (delegated) administrative / financial power commensurate with that posts. In the instant case also the Zonal and Divisional Managers enjoy certain administrative and financial power which are not available to the officers placed lower in the hierarchy.
Therefore, in the event, there is a need to take a decision at the Division of Zonal level the respective Managers action may be called for.
In view of the forthcoming discussion, we are of the considered view that the prayer for expunging the name of opposite party no.3 made in the Misc. Application cannot be entertained.
As such, the instant Misc. Application stands rejected.
There shall not order as to cost.
