ORDER

Attendance on behalf of both the parties filed through their respective advocates.

Heard learned advocate for both the parties and perused advocate for both the parties and perused the report dated 29.07.2023 of the Branch Manager L.I.C Jehanabad through which the OP has clearified in response to this commission’s order dated 12.08.2023 and has clearly stated that at the time of death of policy holder the policy had already lapsed for non-payment of the premium due in december 2015 which of the premium due in december 2015 whcih could have been paid till January 2015 on account of grace of 30days but since the same premium was not paid, the policy lapsed in february, 2015 and continued as such onwards. Since the death of the policy holder took place on 15.06.2015 during the period of lapsed policy the complainant is not entitled of argument. Learned advocate for the  OP has not disputed the statement of facts stated in the above referred letter dated 29.07.2023 of the OP . In view of the above said facts and the circumstances petitioner is not entitled any relief as claim in para VIII of the complainant in the prescribe form followed by his subsequent petition attached with the complaint. Hence, the complaint is dismissed being without any factual or statutory merit.
