ORDER

Counsel for complainant submits that the complainant after the supply of the cheque from OP-1 has not turned in spite of his informing so he has no say on the memo filed by counsel for OP-1. Perused. memo of OP-1 dt. 21-02-07 filed with letter of Manager to the complainant enclosing a cheque for rs. 12,528/- towards refund of premium wrongly remand and in the chequr for Rs. 4,696/- towards instalment therein. This letter also find receipt of Rs. 17,224/- from two cheques by the complainant and having TI in the presence of two witnesses duly signed. perused the complaint and documents field with it. From perusal of complaint in the light of letter of manager of Op-1 and acknowledgement receipt of two cheques by complainant. Hence we find there is no case for the complaint to produce and thereby the complainant did not list to meet in Advocate so under these circumstances it is held that from Op-1 has concerned with the grievance of the complaint by marking payment of rs. 17,224/- under two cheques towards the claim of the complainant. hence complaint is taken as not pressed by the complainant. in spite of giving opportunity to say on the memo of OP-1.
