Complainant is absent by filing petition on the ground stated therein. O.P is present. None moves the petition at 12.30 P.M. on repeated calls. Heard Ld. Advocate for the OP.

            On a close perusals of the materials on record it appears that since long the complainant is taking time on several grounds and did not feel any urge to obey the direction of this Commission.

            Today Ld. Advocate for the OP raised vehement objection against the prayer for. Hence, the prayer for time as file by the complainant considered and rejected. Considering the conduct of the complainant as the age also of the case of this Commission. It is of views that the complainant is very much reluctant to proceed with the case which indulged this Commission to dismiss the case for default.

            Hence, it is,

                        Ordered,

                                    that the instant Case No. 90/2016 be and the same is dismissed for default. No cost.

Copy of this order be supplied to the parties each at free of cost.
