Hazira is filed on behalf of the complainant through his Ld. Advocate. Another hazira is also filed on behalf of the OP. An application is filed by the OP (LICI) with a prayer for passing necessary order on the ground that the OP paid the Accidental Benefit Claim of Rs.50,000/- to the recorded nominee, Sri Rabindranath Hazra (complainant), on 19.09.2012 vide cheque no. 091748 of the same date (HDFC Bank, Tamluk). A letter of LICI dtd.19.09.2012 addressed to the Ld. Advocate, Mrs. Shefali Roy, and one Xeroxed copy of said cheque as also one letter of LICI addressed to the complainant are also filed along with the said petition.

          Copy served to the Ld. Advocate for the complainant. Heard both sides. The Ld. Advocate appeared on behalf of the complainant submitted that his client (complainant) received the aforesaid cheque for Rs.50,000/- from OP on 19.09.2012 towards Accidental Benefit Claim for which his client is not intended to proceed further in this case and the instant case may be dismissed for non prosecution.

          The Ld. Advocate for the complainant has made his endorsement to that effect on the petition of the OP filed today. Considering the circumstances, the instant case be and the same is dismissed for non prosecution.
