Today is fixed for admission hearing.

The complainant is present in person before this Commission.

After hearing the Complainant it appears that due to Act Of God, the document (Title Deed) deposited with the Bank was destroyed. The destruction was made by fire. We are unable to hold a view that there was any deficiency in rendering service on the part of the Bank. The reason, for which the document was destroyed, was beyond the control of the Bank and therefore the Bank cannot be held responsible for payment and compensation or otherwise to the complainant. Therefore, the case as made out is not tenable under the Consumer Protection Act.

Hence it is ordered that the case be and the same is dismissed without being admitted.

The complainant is at liberty to get return the copy of the complaint and the documents from the appropriate authority of this Commission as the complaint is not admitted. In this respect the complainant is further directed to submit a separate application praying for return of the abovementioned documents. The appropriate authority of this Commission is hereby directed to take necessary step upon receipt of the application from the complainant so that the complainant can get return of the aforementioned without any further delay.

Let plain copy be given to the parties free of cost as per CPR.
