Final Order / Judgement

Complainant is absent without step. O.P. 1 & 2 are present through their advocate. The case was posted today as the last and final chance of filing evidence in affidavit of the complainant. But the complainant has neither submitted his evidence not any step has been taken. From perusal of order sheets it seems that the complainant was remaining absent without step from last 03.05.2018. Thereafter on 15.02.2022 the representative of the complainant filed his attendance, but neither the evidence was filed nor any step was taken. The Commission on that day passed order directing the complainant to produce his evidence in affidavit on the next date fixed, i.e. 05.05.22 allowing him the last opportunity of filing evidence. But this time also the complainant has failed to comply with the order of the Commission and the Commission posted the case for passing necessary order and passing necessary order on 29.09.22 the evidence of complainant was closed. Again on 11.11.22 the representative of the complainant filed one Petition bearing Pet. No.226/22 stating that due to suffering from Covid-19 for three times and due to some other serious ailments he had to undergone medical treatment outside Assam for which he could not keep contact with the complainant for which evidence in affidavit of the complainant could not be filed inspite of repeated directions of this Commission. He prayed that considering his health problem he may be allowed an another chance to file evidence. Considering the grounds the prayer of the Petition was allowed fixing today as the last and final chance of filing evidence in affidavit. But unfortunately the complainant has this time also failed to produce his evidence before the Commission.

Under the circumstance discussed above I have found no reason to proceed with the case any further as it appears that the complainant himself is not interested to proceed with the case further. Hence the case is dismissed for default of complainant.

Case DISMISSED for default of complainant.
