Unfair Trade Practice and Deficiency in service against the opposite party is the grievance of the complainant.
The case of the complainant is that, he has got his Saving Bank Account before the bank of Op/ Branch Manager, S.B.I. at Hemgir vides Account No.272201501731. On dated 06.03.2014 the complainant issued a cheque amount of Rs. 10,000/- bearing No. 501731 to his Advocate from out of his aforesaid account towards lawyer’s fees, but while his advocate deposited the said cheque in his Account available at SBI, ADB Sadheipali, Sundargarh the Op returned the cheque with Memo causing “99- Other Reason Payment stopped by attachment order” on collection having sufficient cash available in the Account. The complainant proceeded to the bank of Op numbers of time and approached to withdraw the aforesaid money so that he shall pay the lawyer’s fees, but the Op replied payment has been stopped as per attachment order. On demand Op failed to provide any copy of order under which the alleged account of the complainant has been stopped for payment is amounts to deficiency in service by the Op. Due to aforesaid negligence act of the Op, complainant suffered financial, physical and mental harassment resulting which the present complaint petition is filed claiming total Rs. 36,100/- as compensation.
The Opposite party is set Ex-Partee due to his non appearance before the Forum on receipt of notice served sufficiently to him. Even after providing sufficient opportunities the Bank of Op remain absent regularly indicates his arrogance towards providing Bank service is clear case of deficiency of their service.
Considering the above fact and circumstances, in view of our forgoing discussion we held the Op, B.M. ICICI, Hemgir Branch is liable to pay compensation to the complainant due to harassment causing deficiency in their service. Hence we direct the Op (Bank) to pay compensation amount of Rs. 36,100/- to the complainant claimed in his complaint petition towards harassment caused by the Op due to deficiency in service with payment of interest @ 6% per annum from the date of filing of this case. The Op is further directed to payment of the aforesaid award of compensation amount to the complainant within 30 days from the date of passing of this order failing to comply of aforesaid order the amount of interest shall be doubled.
The order is pronounced in the open forum on this day of 25th March, 2015 under the signature and seal of this forum.
Accordingly the case is disposed off.
